These Terms of Use ("Terms") govern your use of the NearUNow mobile application and website (nearunow.ie), operated by HiSpeed Wireless Broadband Ltd, Tramore, Co. Waterford, Ireland ("NearUNow", "we", "us", or "our").
By downloading, installing, or using NearUNow, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. About NearUNow
NearUNow is a last-minute appointment discovery platform. It allows businesses to advertise empty appointment slots and allows consumers to find those slots nearby. NearUNow is a discovery and connection service only.
2. Eligibility
You must be at least 18 years of age to register as a business user on NearUNow. By registering, you confirm that you are 18 or older and have the legal authority to bind yourself or your business to these Terms. Consumers (non-registered users) may browse NearUNow without age restriction.
3. User Responsibilities
3.1 All Users
- You must use NearUNow for lawful purposes only.
- You must not attempt to reverse-engineer, hack, scrape, or disrupt the NearUNow service.
- You must not use NearUNow to harass, defraud, or harm any other user or business.
- You must not impersonate any person or entity.
- You are responsible for maintaining the security of any device you use to access NearUNow.
3.2 Business Users
- You are responsible for the accuracy of all information you provide, including your business name, phone number, service category, location, and availability slots.
- You must ensure that your listed phone number is correct, active, and monitored during the times you post slots.
- You must honour appointments that are arranged via consumer calls generated through NearUNow where reasonably practicable.
- You must not list slots for services that are illegal or prohibited under Irish law.
- You must not list fictitious slots or use NearUNow as a general advertising platform unrelated to genuine last-minute availability.
- You are responsible for all activity that occurs under your account. You must keep your login credentials secure and notify us immediately of any unauthorised use.
4. Business Listing Rules
All slot listings on NearUNow must:
- Represent a genuine, available appointment time at your business.
- Be for a lawful service that you are qualified and licensed to provide.
- Display an accurate business name and phone number.
- Be in the correct service category.
- Be located at your genuine business address.
The following are prohibited:
- Posting slots for appointments that do not exist or cannot be honoured.
- Listing services you are not authorised or qualified to provide.
- Using NearUNow to promote products, events, or services unrelated to appointment-based bookings.
- Creating multiple accounts for the same business to gain visibility.
- Posting misleading, discriminatory, or offensive content in any field.
We reserve the right to remove any listing and suspend or terminate any account that violates these rules, at our sole discretion and without prior notice.
5. No In-App Booking or Payments
NearUNow does not process, handle, or facilitate any payments or deposits between consumers and businesses. All financial transactions are conducted entirely between the consumer and the business, outside of the NearUNow platform.
NearUNow does not provide an in-app booking, reservation, or scheduling system. The "Call to Book" feature opens your device's native phone dialler only. NearUNow is not a party to any arrangement made between a consumer and a business as a result of a call.
6. Call to Book
When a consumer taps "Call to Book", NearUNow launches the native phone dialler with the business's listed phone number. NearUNow has no involvement in, and accepts no responsibility for, any conversation, arrangement, payment, or service that occurs as a result of that call.
Businesses are solely responsible for handling inbound calls, confirming appointments, and providing the advertised service.
7. Intellectual Property
All intellectual property rights in the NearUNow app, website, and content (including design, branding, and underlying code) are owned by HiSpeed Wireless Broadband Ltd or our licensors. You are granted a limited, non-exclusive, non-transferable licence to use NearUNow for its intended purpose.
By posting content to NearUNow (such as a business name, description, or category), you grant us a non-exclusive, royalty-free licence to display that content within the NearUNow platform.
8. Availability and Service
We aim to keep NearUNow available 24/7 but we do not guarantee uninterrupted access. We may suspend or modify the service at any time for maintenance, updates, or other operational reasons, without notice or liability.
9. Limitation of Liability
To the fullest extent permitted by Irish and EU law:
- NearUNow is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
- We are not liable for any loss or damage arising from your use of, or inability to use, NearUNow.
- We are not liable for any disputes, cancellations, no-shows, or issues arising between consumers and businesses following a call made through NearUNow.
- We are not liable for the accuracy of business listings, including phone numbers, locations, or slot availability.
- We are not liable for any indirect, consequential, special, incidental, or punitive damages howsoever arising.
- Our total aggregate liability to you for any claim shall not exceed €100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish law.
10. Indemnity
You agree to indemnify and hold harmless HiSpeed Wireless Broadband Ltd and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of NearUNow, your breach of these Terms, or any content you post on the platform.
11. Termination
We reserve the right to suspend or terminate your account and access to NearUNow at any time, with or without cause, and without prior notice. You may also delete your account at any time through the app or by contacting us at info@nearunow.ie.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
If you are a consumer in the EU, you may also have the right to refer a dispute to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to These Terms
We may update these Terms from time to time. Business users will be notified of material changes via email or an in-app notification. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of NearUNow after changes constitutes acceptance of the updated Terms.
